Sherlund: Microsoft's Surface will be licensing Windows same as other OEMS

There are lots of interesting tidbits from a note to investors that Nomura analyst Rick Sherlund just sent out, following his meeting this morning with Microsoft Corporate Vice President Mike Angiulo and Windows division Chief Financial Office Tami Reller.

Among the highlights:


  • Microsoft "has stated that its own hardware group would license Windows on the same terms as other OEM partners," Sherlund says in the note.
  • Microsoft will report its Surface revenues in the Windows and Windows Live division.

    ("We would like to see the hardware portion broken out separately so there is transparency between the Windows revenues and the hardware portion so we could assess the margins on the hardware side," Sherlund writes. "MSFT has not commented on whether it will be selling its hardware at a loss initially as volumes ramp as we had observed with the Xbox console business, but we would not be surprised to see this early on")

  • Sherlund expects Windows 8 to be released to manufacturer in mid-to-late July, with general availability in mid-October. (That's been the consensus expectation so far, too.)
  • Sherlund writes that his hands-on experience with Surface was positive.

Lions extend contract with coach Jim Schwartz

DETROIT (AP) ? The Detroit Lions have accomplished one more goal this offseason, keeping another cog in the franchise's turnaround.

Detroit and coach Jim Schwartz, who had one year left on his deal, agreed on a contract extension. Lions spokesman Bill Keenist said Friday night that the team won't disclose details of the new contract.

Schwartz and the team consistently refused to comment on negotiations this offseason.

There was no doubt, however, that the Lions didn't want to let him get away.

He helped Detroit reach the playoffs last season just three years after inheriting a team coming off the NFL's first 0-16 year.

The Lions gave the former Tennessee Titans defensive coordinator his first chance to be a head coach in 2009. Schwartz won two games in his first year, six the next and 10 last season. He led the franchise to double digits in wins for the first time since 1995 and into the postseason for the first time since the 1999 season.

All-Pro receiver Calvin Johnson had his contract extended this offseason by Detroit, which also retained standout defensive Cliff Avril, linebacker Stephen Tulloch and offensive tackle Jeff Backus. Cornerback Eric Wright, who left as a free agent to sign with Tampa Bay, is the only significant player missing from last season's team.

The Lions, however, have marred their offseason with arrests that have led to at least one suspension. Running back Mikel Leshoure will miss the first two games without pay and will have to give up two more game checks for violating the NFL's substance-abuse policy. Defensive tackle Nick Fairley will likely also be suspended because he was arrested twice in two months.

On the field, the Lions have found a leader they've been looking for a long time.

Detroit hasn't had a coach lead the team for more than four seasons since Fontes won 138 games from 1988-96.

Bobby Ross, Gary Moeller, Marty Mornhinweg, Steve Mariucci, Dick Jauron ? on an interim basis ? and Rod Marinelli all had a chance to lead a franchise with only one playoff victory since winning the 1957 NFL title before Schwartz was hired.

"I don't shy away from a challenge," Schwartz said in 2009 following a second interview with the Lions.

Schwartz, who is from Baltimore, played linebacker at Georgetown and graduated with a degree in economics.

He started his coaching career as a graduate assistant at Maryland in 1989, later had the same position at Minnesota and went on to become a secondary coach for North Carolina Central and linebackers coach at Colgate. Schwarz was a college and pro scout for the Cleveland Browns and spent three years on the Baltimore Ravens' staff before moving on and up with the Titans.

The Lions have taken on the personality of their demonstrative coach, who had to be separated from San Francisco coach Jim Harbaugh after a loss last year.

"Coach is fiery. We love that about him," Detroit offensive lineman Rob Sims said last season. "I think he's a great leader in regards to that, just staying positive, being emotional. Some guys, they try to just hide."

Google tablet will indeed be cobranded with ASUS, says insider

We already suspected as much -- not least from the FCC filing above -- but an unnamed executive at Asustek Computer Inc has reportedly just confirmed that Google's much-rumored new tablet will be co-branded with ASUS. According to Reuters, the employee said the tablet will help Google to "target Amazon" and the Kindle range of tablets and e-readers. Despite the existence of Google Play Books, which are available on any Android tablet, the insider said that Google "doesn't have anything like Amazon's service" -- a quote which may not make a ton of sense, but which does support the general notion of a $199 rival to the Kindle Fire.

Some gastric bypass patients see diabetes recur
Type 2 diabetes is often cured by gastric bypass, a form of obesity surgery that creates a short-cut for food in the gut and leads to substantial weight loss. But a new study finds that 14 of 66 gastric bypass patients who had thrown away their diabetes drugs after the operation saw the condition return two to five years later. Yessica Ramos, an internist at the Mayo Clinic Arizona in Scottsdale, reported that these patients saw the recurrence even though on average they maintained most of their weight loss. These 14 patients were more likely than patients who remained diabetes-free after the procedure to have had the disease for more than five years before surgery. Patients with long-term diabetes may have suffered more damage to insulin-making beta cells in the pancreas than the other patients, Ramos said. ? Nathan Seppa

Secondhand smoke tied to diabetes, obesity
Being exposed to someone else?s tobacco smoke boosts a person?s risk of developing type 2 diabetes, a new study shows. Past research has associated smoking with a heightened risk of diabetes, even though smokers often are not overweight. In the new study, physician Theodore Friedman of Charles R. Drew University of Medicine and Science in Los Angeles reported that adult nonsmokers who were consistently exposed to smoke had a greater likelihood of being obese or having diabetes than nonsmokers who had only trace exposure to tobacco smoke. The risks of secondhand smoke exposure showed up even after the researchers accounted for differences in age, sex, race, alcohol consumption and physical activity. The researchers tapped medical data from more than 6,300 adults for the study and used blood levels of cotinine, a surefire marker of smoke inhalation, as a gauge of secondhand exposure.

Oxytocin may fight obesity, fatty liver disease, mouse study shows
A hormone better known for its role in social bonding, reproduction and possibly emotional attachment might also regulate appetite, tests in mice show. Oxytocin helped mice shed weight that they had put on while eating a high-fat diet, researchers reported. Yuko Maejima of Jichi Medical University in Shimotsuke, Japan, found that obese mice injected with oxytocin or given the hormone through a tiny implanted pump ate less and shed excess body weight. The hormone also lessened a pre-diabetic condition called impaired glucose tolerance in the mice, reduced belly fat and alleviated a dangerous condition called fatty liver. Oxytocin seemed to work better in male mice than females. Oxytocin has been considered for combating postpartum depression and as a treatment for autism or other neurological conditions (SN Online: 5/11/11). But questions linger regarding those applications (SN: 2/26/11, p. 15).

Vitamin D low in obese teens
Roughly half of teenagers getting ready to undergo bariatric surgery register exceptionally low levels of vitamin D. Researchers found that among 219 obese teens preparing for the operation, 54 percent were deficient in vitamin D as revealed by a blood test. Another 29 percent registered as having insufficient levels. Blacks were particularly deficient in the vitamin. These very obese children may not get outside much, limiting their sun exposure and their ability to make vitamin D, said study coauthor Marisa Censani, a pediatric endocrinologist at Columbia University Medical Center. ?Also, since vitamin D is fat soluble, it may be sequestered in fat cells and not made available? to other tissues, she said, and consequently wouldn?t show up in blood measurements. Links between obesity and vitamin D deficiency are well documented in adults but less studied in kids. ?These results support screening of all adolescents who are morbidly obese for vitamin D deficiency, especially prior to bariatric surgery,? New thyroid assessment might lessen need for surgery
A new genetic test may help determine whether thyroid growths are malignant or benign and help doctors steer a patient toward surgery or ongoing monitoring, a study shows. Roughly 10 to 30 percent of thyroid growths, called nodules, are termed inconclusive by initial standard lab tests, so researchers analyzed 265 such tissue samples. By gauging the activity of 167 genes in these tissues, the new test correctly spotted 78 of 85 that more extensive testing had shown to be malignant. The seven false-negative findings ?might have arisen from insufficient sampling of tissue,? said study coauthor Erik Alexander, a physician at Harvard Medical School. U.S. doctors do roughly 450,000 needle biopsies of thyroid nodules every year, and about 70,000 come back inconclusive and lead to more testing or surgery. ?There is a lot of unnecessary intervention,? Alexander said. The gene test, with roughly 95 percent accuracy, could help to reclassify many of those nodules, he said. The test was made available in the United States in April. The new findings were also published online June 25 in the New England Journal of Medicine. ? Nathan Seppa

(AP) ? Hackers have broken into a prominent Russian opposition leader's Twitter and email accounts, replacing his image with an iconic Russian musketeer movie character, and sending his followers abusive messages.

Alexei Navalny's spokeswoman, Anna Veduta, told The Associated Press on Tuesday that Navalny is not going to create new accounts, and warned his quarter of a million Twitter followers that the stream of abuse is fake.

Amongst the many changes, hackers wrote "Alexei Navalny is a crook and thief 2.0" in his profile.

"I'm disbanding my sect, but I'm not going to give you your money back because I need it to party in Mexico, so you can all go to hell," one tweet read.

Veduta said Navalny "hopes to regain access to his accounts" eventually.

The 36-year-old opposition leader has been at the forefront of anti-Putin protests. His home and office were raided and he was interrogated several times as part of a probe into violence at a May 6 opposition rally.

Navalny linked the hackings to his personal computer and iPad being seized by police in a raid on his apartment on June 11.

The Investigative Committee on Tuesday brushed off Navalny's accusations of being instrumental in the hacking and described them as "pressure" and "an attempt to discredit the investigators."

Navalny reiterated in a message posted on Facebook, verified by the AP, that he is "sure that the hacking was performed with the help of seized hardware" and pledged to demand that the hackers be found and charged.

Faced with a choice of unfollowing the opposition leader or putting up with a flood of abusive tweets, Navalny's followers seem to be opting for the former. Their number has dwindled from over 258,000 early Tuesday morning to 254,000 at noon Moscow time.

The only difference is the packed lineup FX has arranged around it, with fellow returnee Wilfred and new series premieres from Charlie Sheen in Anger Management and Brand X with Russell Brand.

Case-Mate Barely There Case for HTC One X/XL

Case-Mate barely there

The HTC ONE X  is a beautifully designed phone. The polycarbonate body feels like it is tough – but I do worry about scratches and how it would weather a drop.

While it certainly seems well built and sturdy, I would not be very happy if  I dropped the HTC ONE X– either on the face of the device or on the back with the protruding camera.

A good case makes me feel better about the investment in the phone and it is good insurance against the unforeseen. However, these new HTC devices are pretty big and I don’t want to add to the size. The HTC One X is also incredibly thin and I wouldn’t want to compromise that feel either.

But for some households, a family dinner is an improbable and unrealistic occurrence.

In the Boston area, one organization is trying to change that by modeling the tradition. The Family Dinner Project ? a grass-roots organization that bills itself as a "movement of food, fun and conversation about things that matter" ? aims to promote the benefits of the family dinner and connect families with the resources they need to start a family dinner tradition of their own.

"We're trying to orient kids to a meal, to interest them in conversation," says executive director John Sarrouf. "We want everyone to come to the table to be together, to communicate, to ask questions of each other, to have fun, and to make memories."

Many researchers say that families who break bread together regularly may have lower rates of underage substance abuse, teen pregnancy, depression, and problems in school. So the project holds outreach programs promoting the dinner concept at local schools.

At one such event ? held recently at the Robert L. Ford School in an impoverished area of Lynn, Mass. ? volunteers set up a half-dozen cafeteria tables, each set with real flatware and plates, and candles. As families trickled in, the kids were invited to make centerpieces using flowers and rocks.

As one little boy in bright plaid manhandled a plate of cracker hors d'oeuvres, Mr. Sarrouf attempted a kindly redirect, explaining the etiquette of touching only the thing you want to eat.

Socioeconomic factors can definitely affect the ability of families to set aside time for dinner together, explained Claire Crane, principal at the school, where most students qualify for free lunches. "Most families here ... work two or three jobs," Dr. Crane said. "[F]or some of the families here, this is the first opportunity they have had to do this. When I was a little girl, we ate at 5. We need to go back to that."

Over aluminum trays of lasagna, children chattered and parents talked. Jennifer Paulino brought her two children and three stepchildren to the event without her husband, who had to work. Ms. Paulino looked tired, but happy to be at the dinner. She said she'd recently found a job and was hoping eventually to go back to school. The biggest challenge to dinner in her family is scheduling a time when neither parent is at work, she said.

At another table, Pam Taylor was waging a losing battle against the stubborn tomato sauce adorning her young grandson's face. The mother of six grown kids who now has custody of her three grandchildren, Ms. Taylor suddenly has a new brood to feed.

"But I'm used to having a lot going on," she said. She makes her grandchildren sit down to dinner now. "We make a point of having them sit with us, say grace. The TV goes off. If the phone rings, I just let it ring.... I'm fortunate because I am home, and they're young enough that they can't say, 'I'm taking off to go hang out with friends.' "

As the evening wound down, children helped clear the plates and clean the tables. Salvatore, age 4, the youngest of Taylor's grandchildren, finally sat still long enough for her to wipe his face. His favorite part of the dinner? Making whipped cream for dessert.

PACIFIC, Wash. -- Council members in the town of Pacific are meeting with the city's insurance company this Monday in executive session. Some worry the city is at risk of losing insurance coverage, which would effectively shut Pacific down.

"We cannot function as a city" if Pacific loses coverage, says councilmember John Jones. "Everything we do becomes completely liable. Every employee becomes liable as an individual. You shut your city down."

At the center of the controversy is Cy Sun, the newly elected mayor. The 82 year old won the election as a write-in candidate campaigning on clearing the "money-grubbers" out of city government.

Under his leadership at least seven department heads have been fired or quit their posts.

"What I did was clear out all the high salary people that wasn't doing very much," Sun said.

But some say there are too few people left to run city hall. Business owners complain about delays in permitting, licensing and road projects.

Sun admits to signing one building permit himself, before he realized that he wasn't qualified to do so. Critics say his actions have opened them up to liability issues.

The council meeting is 630 p.m. Monday night.

Ecuador's quandary over asylum for WikiLeaks chief

QUITO, Ecuador (AP) ? President Rafael Correa's objections to what he deems American interventionism in Latin America and his delight in Julian Assange's massive uncorking of U.S. secrets appear to have persuaded the WikiLeaks chief that Ecuador offers his best shot at avoiding extradition to Sweden.

But four days after Assange ducked into Ecuador's London embassy seeking political asylum, this South American nation's leftist leader has yet to announce a decision. The choice may not be easy.

Correa was cagey on Thursday night, telling reporters that Ecuador was consulting with the other governments involved.

"We don't wish to offend anyone, least of all a country we hold in such deep regard as the United Kingdom," he said.

The question he faces is whether it's worth risking a backlash from Washington and the European Union against his small, petroleum-exporting nation of 14 million.

On the plus side, Correa would deepen his anti-establishment reputation by identifying himself with someone who also rates the mainstream media as beholden to moneyed interests and powerful governments.

"By giving Assange asylum, Correa (would be) burnishing his anti-US credentials," said Michael Shifter, president of Inter-American Dialogue, a nonpartisan think tank in Washington, D.C. "Correa and Assange not only have a personal chemistry ? they also see themselves as victims of U.S. power."

The two seemed to get on well when Assange interviewed Correa last month for his Kremlin-funded TV program. "Your Wikileaks have made us stronger," Correa told Assange, adding later: "Welcome to the club of the persecuted."

"It is hard to escape the irony that Correa, who has suppressed press freedom in Ecuador, is associating himself with the professed champion of transparency," said Shifter. "What this reveals is that it all comes down to ideology."

Correa has angered human rights and media freedom activists by using criminal libel law and media ownership restrictions to gag opposition-owned outlets that he claims are corrupt and intent on destroying him.

The tactic hasn't hurt him domestically, however. The leftist economist who took office in 2007 is popular with lower-class Ecuadoreans who benefit from his generous public spending. His approval ratings top 70 percent.

Nor is Correa as relentlessly hostile to Washington as President Hugo Chavez of Venezuela. Unlike Chavez, he has never accused the U.S. of trying to overthrow him. But he does relish courting U.S. global counterweights including Russia, China and Iran.

And he boycotted April's Summit of the Americas in Colombia to protest Washington's continued insistence on excluding Cuba from such hemispheric summits.

Correa has also expelled three U.S. diplomats whom he considered threats, including an ambassador who suggested in one of the more than 250,000 U.S. diplomatic cables that WikiLeaks laid bare that Correa was deliberately overlooking high-level police corruption.

But none of that guarantees he'll grant the Australian activist refuge.

"The internal political and economic costs of asylum don't square up with the benefits," says Grace Jaramillo, an international relations expert at Ecuador's FLACSO university.

"We're in an election year in which a strangling of relations with European countries and the United States, with which we are, respectively, negotiating a trade agreement and the renewal of preferential tariffs, would give them a good excuse to stop negotiations," she said.

"Ecuador could basically forget about any renewal of the trade preferences if it granted safe haven to Assange," said Cynthia Arnson, Latin America director at the Woodrow Wilson center in Washington.

Forty-five percent of Ecuador's exports go to the U.S. and account for about 400,000 jobs. And a failure to reach a trade pact with the European Union could cut exports by 4 percent and cost tens of thousands of jobs.

There's also a risk for Correa of having Ecuador "become catalogued as a country that obstructs justice" and "protects transgressors of international law," said political scientist Vicente Torrijos of Rosario University in Bogota, Colombia.

That could cost him votes when he runs for re-election early next year.

On the other hand, he would win points with Latin American leftists for whom Assange is a "gigantic symbol" of the crusade against what they see as America's heavy-handedness in the region, said international relations specialist Sandra Borda of the Universidad de Los Andes in Bogota.

But she doesn't believe Washington would punish Ecuador if it accepted Assange. And in Washington, the State Department sought to keep out of the crossfire.

"This is a UK-Ecuador-Sweden issue," U.S. State Department spokeswoman Victoria Nuland said Wednesday. "We want to see justice served; let's leave it at that."

On the streets of Quito, some had only a vague notion of who Assange is.

One man who did know, 43-year-old lawyer Julian Amaya, didn't think bringing the former hacker to Ecuador was a good idea.

"It doesn't make sense," he said, "because who is going to guarantee that he doesn't do the same thing here: reveal the secrets of the government, or of the opposition or whomever he wished?"
